Choosing the right lawyer means assuring the proper development of your file.

The lawyer’s roles are varied but each play an important element in the success of your case and your peace of mind:

- He is your advisor and your  counselor: he explains your rights and how to protect them;

- He is the intermediary with the opposing party: he makes the appropriate compromises in cases of negotiation;

- He acts on your behalf: hedrafts the proceedings to structure your case strategically and pleads before a Judge;

- Your relationship with your attorney must always be built on confidence.

Did I make the right choice?

A lawyer is a professional who has his own personality and organization style. Certain lawyers tend to take an offensive stand when involved in a file while other attorneys prefer a consensual method of proceeding. What we see as “typical Hollywood behavior” from lawyers on television is seldom appreciated by Judges in real life, who must base their decision on legal principles – not dramatization of facts.  Or even more problematic: is the overly aggressive lawyer truly helping his client, or simply satisfying his own ego to always be in control?  Sometimes a client is not totally satisfied with their attorney’s particular way of proceeding and may wish to try a different approach with a new lawyer.

This decision to change attorneys may have consequences. For example, the client does not want to see his lawyer fees escalate, the prior attorney had been on the file since the very beginning and therefore knows the whole situation very well, he is the one who drafted all the procedures, the new attorney will need to take the time to familiarize himself with the file in order to be able to represent the client, the new attorney will need to be fully up to date on all the facts of the case, etc…

How do I resolve these issues?

St-Clair & Associates is aware of this reality and that is why we have created the “Trade-In” program. When a client looking for new representation comes in for a consultation, we will evaluate their file and offer them a time credit in order to minimize their costs.  The time required to study the file and restructure the case strategy will not be billed to the client.

The time credit will be evaluated according to the following criteria:

- The status of the file: how advanced is it?
- The area of law;
- The complexity of the cause.
