The amount of child support payable is determined, in part, by the Child Support Guidelines established by the federal and provincial government. The federal guidelines apply during a divorce when one of the two parents live outside the province of Quebec. Federal guidelines are based mainly on the revenue of the parent paying child support. The provincial guidelines are used in all other cases. Provincial guidelines take into consideration the revenues of both parents. If there is a judgment ordering you to pay child support, you must respect the judgment and its conditions. Certain unforseeable circumstances may arise in our life that change our capacity to pay, such as the loss of employment. This "significant change of circumstances" may be sufficient grounds to request a modification or a cancellation of the support payments - but you must obtain a judgment from the Court. The Court will evaluate your application to determine whether a modification or cancellation is justified. For example, if you lost your employment, a Judge will verify whether the loss of employment was beyond your control or whether you voluntarily stopped working to avoid paying child support. |
